POWERADE® Baseball Sweepstakes Official Rules.
No Purchase Necessary. Void where prohibited.

1. PROMOTIONAL PERIOD: The POWERADE® Baseball Sweepstakes ("Sweepstakes") begins at 2:01 p.m. ET on May 1, 2009 and ends at 4:59 p.m. ET on August 31, 2009.

2. TWO WAYS TO ENTER: To Enter Online: Visit POWERADEPlayBall.com and complete the online entry form as prompted. All information must be complete to be eligible. You may come back once per day to enter. Limit one online entry per person/email address per day. Use of computer programs and/or other automated devices to enter sweepstakes is prohibited. Normal Internet access and usage charges imposed by your on-line service will apply. To Enter Via Mail: Hand print your name, complete address, zip code, daytime phone number, date of birth and email address (if known) on a plain 3"X 5" piece of paper. Mail your entry in a hand addressed stamped envelope to: POWERADE® Baseball Sweepstakes, P.O. Box 7879, Melville, NY 11775- 7879. Limit one entry per envelope. Mail-in entries must be postmarked by August 31, 2009 and received by September 8, 2009, to be included in the random drawing. Mechanically reproduced mailed entries are automatically void.

3. RANDOM DRAWING: One (1) Grand Prize and ten (10) First Prize winners will be selected in a random drawing from among all eligible entries received. Drawing will be conducted on or about September 10, 2009, by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final and binding on all matters relating to the Sweepstakes. Odds of winning are dependent upon the number of eligible Sweepstakes entries received. Limit one prize per person/household.

4. PRIZES: Grand Prize (1): Winner's choice of one of the following: a) A professional coaching experience with professional baseball player, Ryan Howard or another professional baseball player of Sponsor's choice in the event Ryan Howard is unavailable, for the winner and his/her little league team or his/her child's or relatives little league team for approximately one (1) hour. Little league team can have no more than twenty (20) people (players and coaches). Date of coaching experience subject to Ryan Howard's availability after the 2009 baseball season has ended; the approximate retail value of the Grand Prize option a) is $3,200, or b) A 2-day/1-night trip for two (2) for a professional coaching experience with professional baseball player, Ryan Howard or another professional baseball player of Sponsor's choice in the event Ryan Howard is unavailable, for approximately one (1) hour. Trip includes round trip economy air transportation tickets from the major gateway airport nearest winner's U.S. home to a Sponsor selected location, one (1) night hotel accommodations (one room, based on double occupancy). Dates of trip/coaching experience subject to Ryan Howard's availability after the 2009 baseball season has ended. The approximate retail value of the Grand Prize option b) is $3,000. Actual value of the trip will vary based on destination and point of departure. First Prize (10): Sponsor-specified $1,000 in gift cards for sporting goods. Gift cards are subject to expiration dates and restrictions set forth on specific gift card. Prizes consist of only those items specifically listed as part of the prize. Prizes are nontransferable and must be accepted as awarded. No cash or other substitution may be made except by Sponsor in the event that the prize (or portion of prize) cannot be awarded for any reason, in which case, Sponsor will award a prize of equal or greater value.

5. ELIGIBILITY: Sweepstakes open to legal residents of the United States and the District of Columbia, who are 13 years of age or older as of May 1, 2009, and have their parent's/legal guardian's permission to enter (if entrant is a minor). Employees of Energy Brands Inc., d/b/a glacéau ("Sponsor"), the Sponsor's parents, subsidiaries, affiliated companies, agents, and Don Jagoda Associates, Inc., and the immediate family (defined as parents, spouse, children, siblings, grandparents) of each such employees, and all those with whom such employees are domiciled, are NOT eligible. Void where prohibited or restricted by law. Subject to all federal, state and local laws and regulations. An eligible minor should have his/her parent's or legal guardian's permission to enter.

6. GENERAL RULES: Potential Grand and First Prize winners (or parent/legal guardian if winner is a minor) will be required to sign and return an Affidavit of Eligibility, Liability Release, and where legal, a Publicity Release within ten (10) days of notification attempt. Noncompliance within this time period will result in disqualification and another winner selected in the place of the disqualified person at random from all eligible entries received. Any prize/prize notification returned as non-deliverable will result in disqualification and an alternate winner selected. By accepting a prize, winner agrees that the Sponsor and those acting under the Sponsor's authority, may use winner's name, picture/portrait, likeness and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law. If an eligible minor is selected as a potential prize winner, such minor's parent or legal guardian, will be required to sign all documents and fulfill all required conditions as set forth in these Official Rules, including accompanying minor on trip (for Grand Prize, if applicable). All travel/coaching experience must be completed on date(s) specified by Sponsor. Date(s) subject to change. Parents of little league team members need to sign releases for the coaching experience prior to use of prize. Travel companion (or parent/legal guardian if a companion is a minor) of the Grand Prize winner (if applicable) will be required to execute a Release of Liability prior to departure. Grand Prize winner and travel companion must travel together on the same itinerary (if applicable). Meals, drinks, activities, gratuities, items of a personal nature, hotel incidentals and any other expenses not specified are the winner's responsibility. A valid photo ID is required by winner and travel companions at time of departure. In the event Ryan Howard is unavailable due to circumstances beyond Sponsor's control, an alternate professional (in Sponsor's sole discretion) will be substituted and no additional compensation will be provided. Entrants agree to be bound by these Official Rules and the decisions of the judges. BY ACCEPTING THE PRIZE, WINNER AGREES THAT THE SPONSOR, THEIR SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE RELEASED PARTIES' OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY. All entries become the sole property of Sponsor and none will be returned. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the online portion of the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the online portion of the Sweepstakes and award the prize from among all eligible online entries received prior to cancellation or termination and all eligible mailed entries received. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for lost, misdirected, damaged, illegible, postage due or late entries or mail. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

7. GOVERNING LAW & VENUE: THE NEW YORK COURTS (STATE & FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SAME. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND HEREBY IRREVOCABLY SUBMITS TO THE VENUE OF THOSE COURTS WITHIN THE COUNTY OF QUEENS.
